If you are an adult, and your citation is dated on or after February 4, 2008, choose whether to pay your ticket or protest your ticket. If your violation was issued to an adult before February 4, 2008, or your violation was issued to a juvenile, this page does not apply. If you want to pay your ticket:The initial penalty amount for these citations is $50 (if paid or protested within 21 calendar days) and the MTA has four payment options – by mail, in person, by phone, or on the Internet. If paying by mail, send a check or money order made out to SFMTA to: SFMTA The transit citation number should be written on the check or money order. Do not send cash. In PersonPayment can be made in person at: SFMTA Customer Service Center Cash, check, money orders, and Visa/MasterCard debit/credit cards are accepted. PhonePayment can be made by phone with a VISA or MasterCard. There is a $2.75 service charge for each citation paid by phone. Call 415.701.3099 or (outside 415 area code) 800.531.7357. InternetPayment can also be made by Internet with a VISA or MasterCard There is no service charge for Internet payments. If you want to protest your ticket:Three levels of review have been established to protest a transit violation and the procedures are very similar to the process for protesting a parking citation. Level 1: Administrative ReviewA request for an initial administrative review must be made to the SFMTA Customer Service Center within 21 calendar days from the date of issuance of the citation. A Notice of Transit Violation will be sent out as soon as the citation has been entered into the system stating that the citation must be paid or protested by a certain due date and failure to do either could result in increased penalties. To protest a transit violation, the Request for Review section of this notice can be used to request an initial review and the form should be brought or mailed in a plain envelope to: SFMTA Citation Review Center Do not use the envelope provided with the Notice of Transit Violation. That envelope is for payment only and a protest will be sent to the wrong address if that envelope is utilized. The results of this review will be mailed to the protestor with instructions on how to protest further if the initial review results in a denial. Level 2: Administrative HearingWhen a protest has been denied at the administrative review level, an administrative hearing may be requested with a hearing officer within 21 calendar days of a denial decision. Hearings are conducted in-person on a first-come first-served basis at the SFMTA Customer Service Center or by mail if that is more convenient for a customer. The fine amount must be paid prior to the hearing and if necessary, one continuance, not to exceed 21 days, will be granted. However, if the hearing is not requested within these time limits, no further review of the transit citation is required. Payment must be made before a hearing is conducted and the Hearing Section recommends for mail hearings that you make a payment by Internet (no fee). Otherwise, include a check or money order payable to SFMTA with the written protest. Make sure that the transit citation number is written on the check or money order. After reviewing any testimony and documentation submitted, the hearing officer will make a decision and notify the protestor by mail. If a protest is upheld, the penalty amount will be refunded by the City but if a claim is denied, the hearing officer will provide written instructions to a protestor on how to file an appeal with the SF Superior Court. In PersonTo request an in person hearing within 21 calendar days of the administrative review decision bring a copy of the citation and any documents or witnesses in support of the protest and appear at: SFMTA Customer Service Center Mail HearingTo request a mail hearing within 21 calendar days of the administrative review decision, send a written protest along copies of any supporting documents or evidence to: SFMTA Hearing Section Level 3: San Francisco Superior Court De Novo HearingWhen a claim is denied in an administrative hearing, an appeal may be filed with the SF Superior Court within 30 days of the date of the denial. The Court hears the appeal de novo—that is, the court considers the case anew and no deference is given to the hearing officer’s decision although the SFMTA Hearing Section’s files are received as evidence. This appeal may also be done either in person or by mail and instructions are provided for both methods. However, if an appeal is not made within the required time frame, no further review is mandated by law. In PersonTo schedule an in person de novo hearing take the administrative hearing denial letter along with a $25 filing fee per citation to: San Francisco Superior Court The court dates are issued on personal request at 850 Bryant Street. If the Traffic Commissioner upholds the protest, the $25 filing fee as well as the citation penalty amount will be refunded. Mail HearingTo request a mail de novo hearing, submit a copy of the administrative hearing denial letter with any evidence or documentation supporting the protest along with a check or money order in the amount of $25 payable to San Francisco Superior Court to: Traffic Commissioner San Francisco Superior Court If the Traffic Commissioner upholds the protest, the $25 filing fee as well as the citation penalty amount will be refunded.
